The appellant, hereinafter referred to as "defendant", was charged with driving while under the influence of intoxicating liquor under Section 34.113 of the Traffic Code of Kansas City. He was convicted in the Municipal Court and appealed to the Circuit Court where the case was tried de novo without a jury. He was there again convicted and he was fined $100.00 and costs and sentenced to two days at the Municipal Farm, to be served on a weekend. Defendants motion for a new trial or in the alternative to discharge was overruled and this appeal followed.
